Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Learning Clarity ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. If you are between 15 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms with you. The Service is not available to children under 15.

2. Description of Service

Learning Clarity is an AI-powered educational platform available on web, Android, and iOS that provides personalized learning experiences. The Service includes:

  • Topic & Course Creation: Create learning topics and courses by uploading educational materials (e.g., PDFs) or providing text descriptions.
  • Explain Mode: AI-generated, chunk-based explanations with interactive knowledge checks and visual aids.
  • Quiz Mode: Adaptive assessments with multiple question types to evaluate understanding.
  • AI Learning Plans: Personalized, AI-generated study plans based on your learning goals and progress.
  • Progress Tracking: Dashboard with learning history, quiz results, performance analytics, and learning streaks.
  • Content Sharing: Share topics, courses, and learning plans with other Learning Clarity users.
  • Supervision: Ability for authorized supervisors (parents, guardians, educators) to monitor a learner's progress.
  • Contact Us: In-app support form to reach our team for account, billing, or technical assistance.

3. Account Registration

  • You must provide accurate and complete information during registration, including your name, email address, date of birth, gender, and preferred language.
  • You may register using an email address and password, or via Google or Microsoft OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
  • Each person may maintain only one account. Creating multiple accounts may result in termination of all associated accounts.
  • You must confirm your email address before your account becomes fully active.
  • You agree to notify us immediately of any unauthorized use of your account.
  • Age requirement: You must be at least 15 years old to use the Service. If you are between 15 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms with you and that you may use the Service with their permission and oversight.

4. Credit System and Payments

Learning Clarity operates on a credit-based model:

  • Free credits are granted upon account creation to help you explore the Service.
  • Additional credits can be purchased through our in-app credit store. Available packages and prices are displayed within the Service and may change over time with prior notice.
  • Credits are consumed when using AI-powered features such as topic creation, Explain Mode, Quiz Mode, and AI Learning Plans.
  • All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you also agree to Stripe's Terms of Service.
  • Credits are non-refundable and non-transferable between accounts, except where required by applicable law. If you believe a charge was made in error, contact us at legal@learningclarity.com within 14 days.
  • Pricing is subject to change. We will provide advance notice of any pricing changes via in-app notification or email.

5. Acceptable Use

You agree to use the Service only for lawful, educational purposes. You must not:

  • Upload, submit, or transmit any content that is harmful, illegal, threatening, abusive, defamatory, obscene, or that infringes on any intellectual property rights.
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or system prompts.
  • Share your account credentials with others or allow unauthorized access to your account.
  • Use automated tools, bots, or scripts to access or interact with the Service.
  • Attempt to circumvent credit requirements, exploit system vulnerabilities, or manipulate the credit system.
  • Use the Service to generate content for any commercial purpose without our express written permission.
  • Use the Service in any manner that violates applicable laws, including data protection and children's privacy laws.

6. AI-Generated Content

  • Educational content including explanations, quizzes, visualizations, and learning plans is generated using artificial intelligence (powered by OpenAI).
  • When you use learning features, your uploaded materials and topic descriptions are sent to OpenAI's API for processing. By using these features, you acknowledge this data transfer to OpenAI.
  • AI-generated content is provided for educational purposes and is not guaranteed to be 100% accurate, complete, or up-to-date. Always verify important information with authoritative sources.
  • The Service should not be used as a substitute for professional educational instruction, licensed tutoring, or academic advising.
  • Learning Clarity is not responsible for any decisions or actions taken in reliance on AI-generated content.

7. Intellectual Property

  • The Service, including its design, code, branding, and features, is owned by Learning Clarity and protected by applicable intellectual property laws.
  • You retain ownership of any educational materials you upload to the Service.
  • By uploading content, you grant Learning Clarity a limited, non-exclusive, worldwide, royalty-free license to process and use that content solely to provide the Service to you (e.g., generating AI-powered explanations and quizzes from your materials).
  • AI-generated explanations and quizzes produced from your content are licensed to you for personal, non-commercial educational use only.
  • When you share content with other users, you grant those users a view-only license to the shared materials for their personal educational use.

8. Supervision Feature

The Service includes a Supervision feature that allows authorized supervisors to monitor learning progress:

  • Supervisors may view learning data including topics, quiz scores, progress metrics, and learning streaks.
  • Users (or their parents/guardians for users under 18) can grant and revoke supervisor access at any time via the in-app settings.
  • Supervisors agree to use the data solely for legitimate educational support and oversight purposes.

9. Account Deletion and Termination

  • Your right to delete: You may permanently delete your account and all associated personal data at any time directly from within the app via Profile → Delete Account. Deletion is immediate and irreversible — all your personal data, learning content, and uploaded materials are permanently removed upon confirmation, subject to legal retention obligations (e.g., financial records). You may also request deletion by contacting us at legal@learningclarity.com or via the in-app Contact Us form.
  • Remaining credits: Any credits remaining in your account at the time of deletion are forfeited and are not eligible for refund, except where required by applicable law.
  • We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service.
  • We may lock accounts for security reasons; locked accounts can be appealed by contacting us at legal@learningclarity.com.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components. AI-generated content may contain inaccuracies; we do not warrant its completeness or reliability.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Learning Clarity and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including damages arising from reliance on AI-generated content. Our total liability for any claims arising under these Terms shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. If you are a consumer located in the European Union, you also benefit from any mandatory protections granted by the laws of your country of residence.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved amicably by contacting us at legal@learningclarity.com. If a resolution cannot be reached, disputes shall be resolved in the competent courts of the Slovak Republic. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page and notify you via in-app notification or email where required by law. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
