Terms of Service | Learning Clarity

1. Acceptance of Terms

Learning Clarity ("the Service") is operated by Intellisys (intellisys.sk), referred to in these Terms as "we," "our," or "us."

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. If you are between 15 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms with you. The Service is not available to children under 15.

2. Description of Service

Learning Clarity is an AI-powered learning service available on the web and in our Android and iOS apps. It includes:

Topic & Course Creation: create topics and courses from materials you upload (such as PDFs, documents and photos) or from a description.
Explain Mode: AI-generated explanations with knowledge checks and visual aids.
Quizzes and Exams: practice quizzes and timed exams with a results report.
Certificates: passing an exam can earn a certificate with a public verification link (see section 7).
Podcasts, Read It Aloud and Voice Conversations: AI-generated audio of your lessons, and spoken or typed conversations with an AI tutor.
AI Learning Plans: personalized study plans based on your goals and progress.
Progress Tracking: your learning history, results, streaks and achievements.
Content Sharing: share topics, courses and learning plans with other Learning Clarity users.
Supervision: let a parent, guardian or educator follow your progress (see section 9).
Referrals: invite others with your referral code.
Contact Us: an in-app form to reach our support team.

3. Account Registration

You must provide accurate and complete information during registration, including your name, email address, date of birth, gender and preferred language.
You may register with an email address and password, or with Google, Microsoft or Apple sign-in. You are responsible for keeping your credentials confidential and for all activity under your account.
Each person may keep only one account. Creating multiple accounts, for example to claim free credits again, may result in termination of all of them.
You must confirm your email address before your account becomes fully active.
Tell us immediately if you notice any unauthorized use of your account.
Age requirement: you must be at least 15 years old to use the Service. If you are between 15 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms with you and that you use the Service with their permission.

4. Credits and Payments

Learning Clarity uses credits rather than a subscription:

New accounts receive free starter credits; the amount is shown when you sign up.
Credits are used by AI-powered features, including creating topics and courses, Explain Mode, quizzes, exams, learning plans, podcasts, Read It Aloud and voice conversations.
You can buy more credits in the Service. Available packs and prices are shown in the Service and may change; a change never affects a purchase you have already made.
Credits do not expire. They stay in your account until you use them or delete your account.
Purchases on the web are processed by Stripe, and by making one you also agree to Stripe's terms. Purchases in our iOS app are made through Apple's App Store In-App Purchase and are also subject to Apple's terms; refund requests for those purchases are handled by Apple.
Referral rewards are credited as described in the Service at the time of the referral.
Credits are non-refundable and non-transferable between accounts, except where the law requires otherwise. If you believe a charge was made in error, contact us at support@learningclarity.ai within 14 days.

5. Acceptable Use

You agree to use the Service only for lawful, educational purposes. You must not:

Upload, submit or transmit content that is harmful, illegal, threatening, abusive, defamatory or obscene, or that infringes anyone's intellectual property rights.
Attempt to reverse-engineer, decompile or extract the underlying AI models, algorithms or system prompts.
Share your account credentials or allow unauthorized access to your account.
Use automated tools, bots or scripts to access or interact with the Service.
Try to get around credit requirements, exploit vulnerabilities or manipulate the credit or referral system.
Use the Service to generate content for a commercial purpose without our written permission.
Use the Service in any way that breaks the law, including data-protection and children's privacy laws.

6. AI-Generated Content

Explanations, quizzes, exams, images, learning plans, podcasts, spoken audio and tutor conversations are generated by artificial intelligence provided by OpenAI and Google. To do this, your materials, descriptions and conversation input are sent to those providers, as described in section 4 of our Privacy Policy.
AI-generated content is provided for learning and is not guaranteed to be accurate, complete or up to date. Check important information against authoritative sources.
The Service is not a substitute for professional instruction, licensed tutoring or academic advice.
We are not responsible for decisions or actions taken in reliance on AI-generated content.

7. Certificates

A certificate shows that you passed an assessment in the Service on a defined body of material. It is not accredited by any university or professional body, carries no academic credit and is not a licence to practise. Do not present it as a formal qualification.
Each certificate has a public verification link and ID. Anyone with them can see the recipient's name, what it was awarded for and when.
Certificates do not expire, but they are deleted with your account, and their verification links then stop working.

8. Intellectual Property

The Service, including its design, code, branding and features, is owned by Intellisys and protected by intellectual property laws.
You keep ownership of the materials you upload.
By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to process and use it solely to provide the Service to you (for example, to generate explanations and quizzes from your materials).
Content generated from your materials is licensed to you for personal, non-commercial educational use.
When you share content with other users, you grant them a view-only licence to it for their personal educational use.

9. Supervision

A parent, guardian or educator can send you a supervision request. Nothing is shared unless you accept it, and you can remove a supervisor at any time.
An accepted supervisor can see your topics, courses, learning plans, quiz and exam results and progress, and receives progress-report emails.
Supervisors agree to use this information only for legitimate educational support and oversight.

10. Account Deletion and Termination

Deleting your account: you can permanently delete your account in the Learning Clarity mobile app under Profile → Security & account → Delete account, or ask us to do it at support@learningclarity.ai or through the Contact Us form. Deletion is immediate and cannot be undone; what is deleted and the little we keep are described in section 9 of our Privacy Policy.
Before you delete: download any certificate you want to keep. Remaining credits are forfeited and are not refunded, except where the law requires otherwise.
We may suspend or terminate your account if you break these Terms, act fraudulently or abuse the Service.
We may lock an account for security reasons. You can appeal a lock by contacting us at support@learningclarity.ai.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee that the Service will be uninterrupted or error-free. AI-generated content may contain inaccuracies; we do not warrant its completeness or reliability.

12. Limitation of Liability

To the maximum extent permitted by law, we and our officers, directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including from reliance on AI-generated content. Our total liability for any claim under these Terms is limited to the amount you paid us in the twelve (12) months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Slovak Republic, without regard to its conflict-of-law rules. If you are a consumer in the European Union, you also keep the mandatory protections of the law of your country of residence.

Please contact us first at support@learningclarity.ai so we can try to resolve any dispute amicably. If we cannot, the dispute will be decided by the competent courts of the Slovak Republic, without affecting any right you have as a consumer to bring proceedings where you live. Consumers may also turn to an alternative dispute resolution body; in Slovakia this includes the Slovak Trade Inspection (Slovenská obchodná inšpekcia).

14. Changes to These Terms

We may update these Terms. When we make material changes we will update the "Last updated" date at the top of this page and tell you in the app or by email where the law requires. If you keep using the Service after the changes take effect, you accept the revised Terms.
